Is escort legal in the Czech Republic?

Yes for two consenting adults, no for anyone who organises it or profits from it. Here is what the Criminal Code, the courts and the town halls actually say, with every source linked.

Czech law has never written a prostitution act. Instead, the sale of sex between adults sits in a gap: nothing forbids it, nothing licenses it, and a handful of criminal offences and local ordinances draw the edges. For a client, the short answer is that paying an adult is lawful. The long answer is below, because the edges are where visitors get into trouble.

The status of sex work between adults

Selling and buying sex between consenting adults is not a crime. In October 2025 the Supreme Administrative Court said in case 22 Afs 24/2025 that voluntary prostitution cannot be treated as a criminal offence under current law, and in the same judgment confirmed that the income from it is taxable.

Governments have tried to regulate the trade several times. The cabinet approved a regulation bill in 2005, and Prague sent its own bill to parliament in 2014, which the government opposed and which lapsed at the end of the term. None became law, so there is no register of workers, no licensed brothel and no health card. One piece of old law did go: the 1922 act that banned brothels was repealed with effect from 2024. That repeal did not create a way to run one legally, for the reason in the next section.

Procuring: the offence that shapes the whole market

Section 189 of the Criminal Code (Act 40/2009) defines kuplířství. It punishes anyone who induces, arranges, hires, lures or seduces another person into prostitution, and anyone who profits from prostitution carried on by someone else. The basic penalty is six months to four years. It rises to between two and eight years when the aim is substantial gain or the offence is committed by an organised group, and higher still when it causes serious harm or death.

The profiting clause reaches further than most visitors expect. In case 8 Tdo 1091/2020 the Supreme Court held that renting night club rooms to women for sexual services is profiting from prostitution. In June 2026 police charged twelve people and two companies in a case where women handed over part of their earnings officially as rent, including for rooms in Brno flats, as ČT24 reported.

This is why agencies call themselves companionship services and why clubs present themselves as bars. The offence targets the organiser, not the client and not the woman working for herself. It is also the reason the independent escort, working alone from her own flat, is the format with the cleanest legal footing.

The age line: eighteen, without exception

The Criminal Code treats anyone under eighteen as a child (section 126). Offering, giving or promising payment for sex with a child is a crime under section 202, punished by up to two years, and by six months to five years if the child is under fifteen. Sex with anyone under fifteen is a separate and far heavier offence under section 187. The general age of consent is fifteen, but the paid-sex line is eighteen. No guide, club or agency can move it, and a professional should never object to showing ID if you ask.

Section 168 on trafficking, with penalties from two to ten years and more, covers anyone who recruits, moves or harbours a person by force, deceit or abuse of distress for sexual exploitation. If you ever see signs that someone is not working by choice, such as a minder who keeps her documents or does all the talking, leave and call the police on 158.

Town ordinances: where the rules change street by street

Section 10(a) of the Municipalities Act lets a town restrict activities that offend public morals to certain places and times, or ban them from public spaces altogether. The Constitutional Court upheld such a ban in Ústí nad Labem in its judgment Pl. ÚS 69/04 of 2007. Breaking an ordinance is an administrative offence, with fines of up to CZK 100,000 under Act 251/2016.

Prague adopted a city-wide ban on offering and providing sexual services in public spaces, in force from 2008, as Radio Prague reported at the time. That is why the capital has no street scene worth the name, and why a tout on Wenceslas Square is selling a bar, not a person.

Some towns go further and fine the client. Cheb, on the Bavarian border, fines both sides of a street deal, and Kaplice in South Bohemia extended its ordinance to clients too. Ordinances cover public space only. A meeting in a private flat or a hotel room is outside them.

Tax, trade licences and advertising

Income from voluntary sex work is taxable, as the 2025 judgment confirmed. Yet there is no trade licence for it: the government regulation that lists the licensed trades expressly excludes services aimed directly at satisfying sexual needs (Regulation 278/2008, field 78). Workers are taxed without being able to register the activity as a business, one of the loose ends every regulation bill has tried and failed to tie.

The Advertising Act has no ban aimed at escort adverts. It does ban adverts for unlawful services and adverts that contain pornographic elements or offend good morals.

What this means for a client

  • Paying an adult for sex, in private, breaks no national law.
  • Agreeing a deal on the street can break a local ordinance, and in some towns the fine lands on you.
  • An agency or club is the party carrying the legal risk, which is one more reason to keep every payment small, in cash and face to face.
  • Anyone under eighteen is a crime, whatever you were told.
  • Signs of coercion are a reason to leave and report, not to negotiate.

Legal questions, short answers

Can a tourist be fined for hiring an escort in Czechia?

Not under national law, which does not punish the client of an adult. The risk is local: some towns fine people who offer or accept sex in public places, and Cheb and Kaplice have extended their rules to clients. Meeting in a private flat or a hotel room is outside those ordinances.

Is it legal to visit a night club with rooms?

Visiting a bar is legal and the client commits no offence by paying an adult woman. The legal risk sits with the operator: the Supreme Court held in 2020 that renting rooms to sex workers is profiting from prostitution.

Do escorts in the Czech Republic pay tax?

Income from voluntary prostitution is taxable, as the Supreme Administrative Court confirmed in 2025. There is, however, no trade licence for sexual services, so the work cannot be registered as a business in the usual way.

What is the age of consent for paid sex in Czechia?

Eighteen. The general age of consent is fifteen, but offering or giving payment for sex with anyone under eighteen is a separate crime under section 202 of the Criminal Code.
